These terms govern your access to and use of Make a Writer. By using the Service, you agree to be bound by them.

Welcome to Make a Writer. These Terms of Use (the “Terms”) govern your access to and use of the Make a Writer platform at www.makeawriter.com (the “Service”), operated by SELLUP LTDA, a company organized under the laws of Brazil, with offices at Rua Dona Izabel A Redentora 2356, Centro, São José dos Pinhais, PR 83005-010, Brazil (“Generating Books”, “we”, “us” or “our”).

By accessing or using the Service, you agree to comply with and be bound by these Terms. If you do not agree with any part of them, do not use the Service.

Section 01

The Service

Make a Writer is an online platform that uses artificial intelligence to help you create book manuscripts. It takes the idea you describe, structures it into an editorial plan, generates chapters, refines the narrative and assembles a finished manuscript across a range of literary genres.

The Service is a writing tool. It does not provide publishing, legal, medical, financial or other professional advice, and nothing it generates should be relied on as such.

Section 02

Acceptance of These Terms

By using the Service, you confirm that you have read, understood and accepted these Terms as well as our Privacy Policy.

We may update these Terms from time to time. The current version will always be available on this page, and the “Last updated” date at the top tells you when it last changed. If a change is material, we will make a reasonable effort to tell you before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms.

Section 03

Who May Use the Service

You must be at least 18 years old to use the Service. By using it, you represent that you are 18 or older and that you have the legal capacity to enter into these Terms.

The Service does not currently use accounts. There is no username, no password and no login. You use Make a Writer by entering your book idea and your contact details directly in the creation flow, and we send your book to the email address you give us.

If we introduce accounts in the future, you will be responsible for keeping your credentials confidential and for all activity that takes place under your account, and you agree to notify us promptly of any unauthorized use.

Section 04

AI-Generated Content and Ownership

4.1 — How generation works

Make a Writer uses artificial intelligence to produce content from the input and instructions you provide. The output is a drafting aid: its quality and suitability depend heavily on the information you give it, and it may contain errors, inaccuracies, repetitions or passages that need editing. You should review everything before you publish it or rely on it.

4.2 — You own what you create

As between you and us, all rights in the content generated through the Service belong entirely to you. We claim no ownership over the books you create. You are free to publish, sell, distribute and use your book however you wish, including commercially, with no royalty owed to us.

One thing you should know, because it is a matter of law and not of our policy: under current United States copyright law, material produced by artificial intelligence without sufficient human authorship may not itself be eligible for copyright protection. We make no representation about the copyright status of any particular output, and we cannot advise you on it. What we can commit to is that we will not assert any claim of our own over it.

We retain a copy of the content you create in order to operate the Service and to give you access to your book, as described in our Privacy Policy.

4.3 — You are responsible for your content

You are solely responsible for all content you generate, edit, publish or distribute using the Service. That includes reviewing and moderating it, and making sure it complies with all applicable laws and regulations and does not infringe the rights of others. Make a Writer is not responsible for user-generated content that is unlawful, offensive, defamatory, that infringes the copyright or intellectual property of a third party, or that otherwise violates applicable law.

Section 06

Pricing, Payments and Refunds

The Service is free today. We do not charge for your book preview, we do not ask for a credit card, and we do not collect or store payment card details of any kind.

Because no purchase can be made, nothing in these Terms creates a payment obligation for you.

Paid access to Make a Writer is not open in the United States yet. When it opens, we will publish the price, the payment processor and the refund policy that apply, and those terms will be shown to you before you buy anything. We will not apply commercial terms to you retroactively through an edit to this page.

Section 07

Disclaimer of Warranties

The service and all content generated through it are provided “as is” and “as available”, without warranty of any kind. To the fullest extent permitted by law, Make a Writer disclaims all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Service will be uninterrupted, secure or error-free, or that the content it generates will be accurate, original, publishable or fit for any particular purpose.

Some states do not allow the exclusion of certain implied warranties, so parts of this section may not apply to you.

Limitation of Liability

To the fullest extent permitted by law, Make a Writer and its directors, employees, partners and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages — including damages for lost profits, lost goodwill, lost data or other intangible losses, even if we have been advised of the possibility — arising out of:

To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or relating to these Terms or the Service will not exceed the greater of (a) the total amount you paid us in the twelve months before the event giving rise to the claim, or (b) one hundred United States dollars (US$100).

Some states do not allow the limitation of liability for incidental or consequential damages. In those states, our liability is limited to the greatest extent permitted by law.

Indemnification

You agree to indemnify and hold harmless Make a Writer and its directors, employees, partners and agents from and against any claim, liability, damage, loss or expense — including reasonable attorneys' fees and costs — arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of the rights of any third party.

Copyright Complaints

We respect the intellectual property of others. If you believe that material made available through the Service infringes your copyright, send us a written notice at contact@makeawriter.com including:

We will review each notice and remove or disable access to material where appropriate. If your material was removed and you believe that was a mistake, you may send a counter-notice to the same address. We may terminate access for users who repeatedly infringe the rights of others.

Section 11

General Provisions

11.1 — Governing law and venue

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. You and we agree that the state and federal courts located in the State of Delaware will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, and you consent to personal jurisdiction in those courts.

Nothing in this section prevents you from bringing an individual claim in a small-claims court where you live, if that court has jurisdiction over it. And nothing in these Terms limits any right you have under the mandatory consumer protection laws of the state where you live.

11.2 — Severability and waiver

If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will stay in full force. Our failure to enforce any provision is not a waiver of our right to enforce it later.

11.3 — Entire agreement

These Terms, together with our Privacy Policy, are the entire agreement between you and Make a Writer regarding the Service and replace any prior agreement on the same subject.

11.4 — Changes to the Service

Make a Writer is under active development. We may add, change, suspend or discontinue features at any time. If we discontinue the Service entirely, we will make a reasonable effort to give you notice and an opportunity to retrieve the books you created.
